Damian specialises in criminal proceedings against a background of business and HR law, as well as internal investigations with a particular focus on corruption, bullying and theft.

Damian has been dealing with criminal procedure law since 2013, representing suspects/defendants and victims before law enforcement agencies and courts. He has been working with Raczkowski since 2016.

In particular, Damian specialises in business criminal law (including criminal labour law) and other procedures of a similar nature. He also deals with other areas, including:

  • whistleblower protection and internal investigations,
  • administrative criminal proceedings,
  • misdemeanour proceedings,
  • inspections by the State Labour Inspectorate and other services,
  • prevention of money laundering and terrorist financing,
  • prevention of sexual offences,
  • training in criminal law and compliance,
  • crisis management,
  • compliance matters.

He was recognised in the 2023 Legal 500 as a recommended white collar crime lawyer.

He develops and implements compliance procedures at clients and has authored various procedures for reporting violations of law and anti-money laundering procedures. He is currently acting as counsel in cases involving:

  • The unauthorised offering of corporate bonds exceeding PLN 220 million, without the approval of the Polish Financial Supervision Authority.
  • The fraudulent acquisition of co-financing from the Agency for Restructuring and Modernisation of Agriculture, amounting to approximately PLN 150 million.
  • Actions detrimental to a listed company, including fraud exceeding PLN 17 million and the provision of false information in stock exchange reports.”

He has written various publications on criminal law and compliance, including:

  • The commentary ‘Employment Crimes and Offences’, the only comprehensive commentary on all employment law offences,
  • The book ‘Whistleblowing and internal investigations’, a comprehensive guide to the whistleblowing system,
  • the first comprehensive commentary on the Law on the Protection of Whistleblowers of 14 June 2024.

In his private life, he is passionate about history. He aspires to visit over 1,000 castles, manor houses and palaces of Lower Silesian by bicycle (to date he has visited around 300).
